HVAC Maintenance Agreement Template (Annual Service Contract)

A maintenance agreement is two lists and four numbers. The lists are what a visit includes and what the plan does not cover; the numbers are visits per year, the parts discount, the term, and the notice period to cancel. Get the second list right and this document prevents arguments. Leave it out and the document causes them.

What goes in an HVAC service agreement

Everything below is a field on the form. The order matters less than the fact that each one has an answer written down before the first visit rather than being decided in a phone call during a heat wave.

Parts discount 15% off parts and repair labor The percentage off parts and repair labor that comes with the plan. This is usually the reason he signs, so put a number on it.
Priority response Same or next business day, ahead of non-members How fast you commit to getting there in season, and what "priority" means when six people call on the same 98 degree Tuesday.
Term and renewal 12 months, renews annually, notice sent 30 days before Start date, end date, and what happens at the end. If it renews automatically, say so in the same size type as everything else.
Cancellation notice 30 days written notice, unused visits refunded How much notice either side gives, and what happens to money already paid. Both directions. A plan you cannot leave is a plan people warn each other about.

Write the not covered list first

This is the part that feels least like selling and does the most work. Refrigerant, parts, repairs, and calls outside the scheduled visits are the four things customers most often assume are included, because "maintenance plan" sounds like it means the system is taken care of.

A homeowner who reads that list and signs anyway has bought exactly what you are selling. A homeowner who never saw it is a person who will be genuinely surprised when a capacitor costs money, and he will be surprised at the worst possible moment, standing in a hot house, holding a document that he believes says otherwise.

Writing it down also makes the plan easier to price. Once the excluded work is explicit, the price is just the labor of two visits plus the filter, and you can defend it line by line.

The task list is what he is buying

"Full system inspection" is not a task list. It is a phrase that shrinks quietly over the years until a visit is a filter change and a look at the gauges. Write the actual checks: filter, coil clean, drain flush, capacitor and contactor, refrigerant pressures, amp draw on the compressor, flame and heat exchanger on the furnace side.

The list has a second job. In year three, when he is deciding whether the plan is worth renewing, the list is the only evidence that anything happened. Nothing you did was visible. The page is the proof.

The way out, in both directions

Say how much notice cancels the plan and what happens to money already paid, and make it symmetric. Thirty days written notice either way, unused visits refunded is a clause that costs you almost nothing and removes the single biggest objection to signing anything annual.

It is worth being blunt about why. Every contractor reading this has been on the other side of a software or supplier contract that could not be cancelled, and knew how that felt. The agreement that is easy to leave is the one people stay in, because staying is a choice they keep making rather than one they got trapped in.

One caution: this is a starting point, not legal advice. Automatic renewal rules, notice requirements and refund obligations vary by state and several have tightened recently. Have a lawyer read your standard terms once, then reuse them for years.
